Lease Agreement - Option to Buy

The Lease Agreement - Option to Buy is suitable for leases where the lessee has 100% use of the horse and pays all maintenance costs. This lease is for an “off property” arrangement (ie. the horse does not live with the owner, but either with the lessee, or at an agistment centre). The agreement is 8 pages in total and includes the following:

• set the term (length of the lease) and weekly fee;
• set agreed purchase price if option to buy is exercised by lessee;
• specify permitted use of horse and what is not permitted;
• all maintenance expenses to be paid by the lessee;
• insurance clause (can be crossed out and deleted if the horse is not insured);
• accident and emergency protocol;
• owner can inspect with 7 days notice;
• basic warranties: full disclosure of any health and soundness conditions, vices or behavioural issues required;
• liability and indemnity clause; and
• standard termination provisions.
